Zec raises exception

HARARE – Zimbabwe Electoral Commission (Zec) has said it cannot be cited as a respondent in election petitions.

The commission raised an exception after being cited as a respondent in some of the petitions filed by losing MDC candidates, who participated in the July 31 harmonised elections.

Zec said according to Section 166 of the Electoral Act, the commission was not included as a respondent in election petitions.

Zec’s lawyers Tawanda Kanengoni and Charles Nyika said that depending on the outcome, the commission may be called upon, by operation of law, to conduct a re-run of the election challenged in a petition.
