HARARE – A 43-year-old Harare man has been dragged to court by his ex-wife for deliberately infecting her with HIV.
Taurai Chichewo, who resides in Kambuzuma Section 6, was charged with deliberate transmission of HIV as defined in Section 79 of the Criminal Law (Codification and Reform) Act Chapter 9:23.
Harare magistrate Elijah Makomo remanded the matter to November 18.
As part of his bail conditions, Chichewo was ordered to deposit $50 with the clerk of court, reside at his given address, not to interfere with witnesses and to report once a week at Warren Park Police Station once every Friday.
The state led by Sharon Mashavira said in August 2012, Olivia Rijemba, a Chitungwiza resident started staying with Chichewo as husband and wife.
She fell sick and complained of pain while passing urine.
Rijemba also realised that she was developing blisters on her privates and went to Chitungwiza General Hospital for examinations.
She then went for an HIV test and found out that she was HIV positive. She confronted the accused for deliberately transmitting the virus to her.
It is the State’s case that the couple continued staying together amicably until Rijemba started pressing charges of “willful transmission” this month. That is when they separated.
According to the State papers, however, the complainant was never tested for HIV before getting married to the accused person.
