HARARE – A 39-year-old man living with HIV has been jailed for 20 years after he was found guilty of raping and infecting his six-year-old niece with a venereal disease as well.
Regional magistrate Fadzai Mthombeni gave Simon Mangwende a straight sentence with no suspended years.
In passing sentence, Mthombeni said Mangwende had confirmed that he had known about his status since 2010, some two years before he committed the heinous offence.
She said in this case, it was clear that the child was treated for an STI and that in itself was aggravating by any standards.
“A six-year-old being treated for an STI as a result of rape is frowned upon by any civilised and reasonable person,” she said.
Facts are that sometime in April this year, the minor was playing outside the house with her friends in Masvingo.
Later the child decided to go inside the house to have a drink of water and Mangwende called her and told her to sit on his lap before he started fondling the child and raping her afterwards.
The girl was instructed to return outside to play after the rape.
Sometime in May 2013, the girl’s teacher noticed that her pupil was not walking properly and asked the child what the matter was. She narrated the rape ordeal.
The minor was taken for a medical examination, leading to her uncle’s arrest.
