BULAWAYO – A Plumtree man living with HIV, who claimed his dead wife was haunting him to be intimate with his 17-year-old daughter in order to be cured of the virus, has appeared in court.
The 45-year-old man who cannot be named to protect the victim appeared before Bulawayo regional magistrate Collect Ncube facing two counts of rape and deliberate transmission of HIV.
He was not formally charged.
As a result of the sexual abuse the man allegedly infected his daughter with HIV.
Prosecutor Robin Mukura alleges that on an unknown date but sometime in August 2007 the man was at home with his daughter.
The court heard that the man invited his daughter to the bedroom where he confided to her that her late mother was always coming to his dreams instructing him to be intimate with her so that he could be cured of HIV, and live longer to look after her.
As if to attract sympathy from the daughter, the father told her that failure to engage in the act would lead to his immediate death.
The court further heard that the following day the man once again invited her daughter to the bedroom hut where he allegedly asked her to make her late mother “happy.”
As a result, the man reportedly ordered her daughter to remove her clothes and undergarment before he raped her without using any protection, the court heard.
For almost 3 months, the father kept sleeping with the daughter without any protection.
In October last year the girl fell sick and was taken to hospital where she was tested for HIV and discovered that she was positive.
The matter came to light when the girl shocked by the results, narrated the ordeal to her uncle’s wife who then escorted her to file a police report leading to the man’s arrest.
The man was remanded in custody to July 4.
